Terms of Service

1. Agreement to these terms
By accessing or using musecollection.org (the "Site") or any services provided through it (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms apply to all visitors, artists, collectors, and anyone else who uses the Platform.
2. Who we are
The Platform is operated by Muse Collection ("Muse", "we", "us"). We are a marketplace connecting independent artists with collectors. Questions about these Terms may be directed to hello@musecollection.org.
3. Artist accounts
To sell on Muse Collection, you must apply and be approved. By applying and creating an artist account, you agree to the following:
- You are the original creator of all work you list. You may not list work created by others, AI-generated work presented as hand-made, or reproductions presented as originals.
- All information you provide — including your bio, artwork descriptions, pricing, and availability — must be accurate and kept up to date.
- You are solely responsible for fulfilling orders, including packaging, shipping, and communicating with buyers.
- You must connect a valid Stripe account to receive payouts. Muse Collection is not responsible for delays caused by Stripe or your banking provider.
- You may not use the Platform to sell work that infringes on any third party's intellectual property rights.
4. Commission and payments
Muse Collection charges a 15% commission on every sale made through the Platform. This commission is deducted at checkout before funds are transferred to the artist's Stripe account. Artists receive 85% of the listed sale price.
Payment processing is handled by Stripe. By using the Platform, artists agree to Stripe's Connected Account Agreement. Muse Collection is not responsible for payment failures, delays, or disputes that originate with Stripe or the artist's banking institution.
Muse Collection reserves the right to adjust its commission rate with 30 days' written notice to active artists.
5. Collector purchases
When you purchase artwork through the Platform:
- You are entering into a contract directly with the artist, not with Muse Collection.
- All sales are final unless the work arrives damaged or is materially different from its description. In such cases, contact us at hello@musecollection.org within 14 days of receipt.
- Shipping costs and timelines are set by the artist. Muse Collection is not responsible for shipping delays or damage in transit.
- You are responsible for any import duties or taxes applicable in your country.
6. Prohibited conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law.
- List, sell, or attempt to sell counterfeit, stolen, or infringing works.
- Circumvent the Platform's checkout to conduct transactions off-platform with buyers discovered through Muse Collection.
- Attempt to manipulate reviews, ratings, or the discovery algorithm.
- Use automated tools to scrape, crawl, or extract data from the Platform without written permission.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
We reserve the right to suspend or terminate accounts that violate these rules without notice.
7. Intellectual property
Artists retain full ownership of the copyright in their work. By listing artwork on Muse Collection, you grant us a non-exclusive, royalty-free licence to display, reproduce, and promote your work in connection with operating the Platform — including on the Site, in emails, and in social media — for the duration of your listing.
When a collector purchases a work, they acquire ownership of the physical artwork only. Copyright remains with the artist unless explicitly transferred in writing.
The Muse Collection name, logo, and Platform content (excluding artist-uploaded work) are our intellectual property. You may not use them without our written permission.
8. Limitation of liability
To the maximum extent permitted by law, Muse Collection is not liable for:
- The quality, safety, or legality of items listed on the Platform.
- The accuracy of artist-provided descriptions or images.
- Disputes between artists and collectors.
- Loss or damage arising from the use of the Platform, including indirect, incidental, or consequential damages.
Our total liability to you for any claim arising from these Terms or use of the Platform shall not exceed the amount you paid through the Platform in the 12 months preceding the claim.
9. Termination
You may close your artist account at any time by contacting us at hello@musecollection.org. We may suspend or terminate your account at any time if you violate these Terms, with or without notice.
On termination, your public profile and listings will be removed from the Site. Completed sales and associated financial records will be retained in accordance with applicable law.
10. Changes to these terms
We may update these Terms from time to time. The date at the top of this page indicates when they were last revised. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will notify active artists of material changes by email.
11. Governing law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be subject to the exclusive jurisdiction of the courts in the relevant territory.
